Terms of Service
These terms are an agreement between Climax Cybra ("we", "us") and the business that signs up for Climax Cybra AI Secretary (the "Service"), plus each person who uses the Service for that business ("you"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy.
1. The Service
The Service is an AI assistant that connects to your business tools, organises your work and drafts or carries out actions. Some actions require approval from someone in your business before they run. We may improve or change features over time, and we will tell you before we remove a major feature you pay for.
2. Accounts
- You must give accurate information and keep your password secure. You are responsible for activity under your account.
- The account owner controls who joins the business account and what each role can do.
- You must be at least 16 and able to agree to these terms on behalf of your business.
3. Your data and connected services
- You keep all rights to your data. You give us permission to process it only to provide the Service, as described in the Privacy Policy.
- When you connect a third-party service, its own terms also apply. You are responsible for having the right to connect it, and to message the people you contact through it.
- You are responsible for complying with laws that apply to your communications, including anti-spam and privacy laws such as CASL.
4. AI output
The assistant uses AI models, and their output can be wrong or incomplete. Review drafts, summaries and suggested actions before relying on them, especially for prices, legal matters, deadlines and anything sent to customers. Approval settings let you decide which actions need a person's review.
5. Acceptable use
You may not use the Service to send spam or unlawful messages, harass anyone, infringe others' rights, break the rules of connected platforms, try to access other customers' data, interfere with the Service, or reverse-engineer it except where the law allows.
6. Plans, trials and payment
- Paid plans renew automatically each month or year until cancelled. Prices are shown in the app before you subscribe and may include applicable taxes.
- Free trials end on the date shown. They do not convert to a paid plan unless you subscribe.
- You can cancel at any time in Plan and billing. Cancellation takes effect at the end of the current period. Payments are non-refundable except where the law requires or we agree otherwise.
- We may change prices with at least 30 days' notice before your next renewal.
7. Suspension and termination
You can close your account at any time. We may suspend or close an account that breaks these terms, puts other users at risk, or is unpaid. Where reasonable, we will give notice first. After closure, your data is deleted as described in the Privacy Policy.
8. Availability and support
We work to keep the Service available and secure, but we do not guarantee it will be uninterrupted or error-free. Connected services can change or stop working for reasons outside our control.
9. Disclaimers and liability
The Service is provided "as is" to the extent the law allows. Neither party is liable for indirect, incidental or consequential damages, or for lost profits. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
10. Changes to these terms
We may update these terms. If a change is material, we will tell account owners at least 30 days before it takes effect. Continuing to use the Service after that means you accept the new terms.
11. Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have jurisdiction over disputes.
